The plain, simple agreement.
These are the terms for using imperfectionist.beauty and buying from us. We’ve written them to be read, not skimmed past. Using the site means you agree to them.
01 Who we are
This website is operated by The Imperfectionist LLC (“The Imperfectionist,” “we,” “us,” or “our”), a limited liability company organized in Wyoming and operating from Boston, Massachusetts. The Imperfectionist® is a registered trademark. When we say “you,” we mean anyone using this site or placing an order.

02 Using this site
You’re welcome to browse, shop, and share our pages. In return, we ask that you don’t misuse the site — no attempting to break, copy, scrape, resell, or interfere with it, and no using it for anything unlawful.
You must be at least 18 years old to buy from us, or have a parent or guardian’s permission and supervision. Our products are cosmetics intended for adult use.
03 Products, colors & availability
Every shade is handmade in small batches, so slight variation between pans is part of how they’re made, not a defect. We photograph our swatches on real skin in real light and don’t retouch color — but screens differ, and the exact shade you see can depend on your device.
We may add, change, or discontinue products at any time, and we can’t guarantee any item will stay in stock. Occasionally an item may sell out after you’ve added it to your cart.
04 Prices & payment
Prices are in US dollars and may change without notice, though changes never affect an order we’ve already confirmed. Payment is processed securely through our checkout provider; we don’t see or store your full card details.
If a price or product detail is listed in obvious error, we may cancel the affected order even after it’s placed. If we do, you’ll get a full refund and an apology.
05 Orders, shipping & returns
When you place an order, you’ll get a confirmation email — that confirms we received it, and forms our agreement to sell you the item. We currently ship within the United States and to the Czech Republic, with rates shown at checkout.
Returns, refunds, damaged items, and cancellations are all covered in detail in our Return & Refund Policy, which forms part of these Terms.
06 Health, safety & no medical advice
This one matters, so we’ve made it plain.
Our shades are cosmetics — eyeshadows made to be worn. They are not medical products, treatments, or devices. Many are named for, and inspired by, the experiences of people living with health conditions. That is a tribute and a way of telling a story. It is not a medical claim. Nothing we sell diagnoses, treats, cures, prevents, or relieves any condition, and nothing on this site is medical, health, or professional advice.
As with any cosmetic worn near the eyes: patch test if your skin is sensitive, keep the product out of your eyes, stop using it if irritation occurs, and speak to a doctor about anything concerning. You use our products at your own discretion and are responsible for checking the ingredient list for anything you may react to.
07 Your reviews & content
If you send us a review, photo, tag, or message — whether by email, on our site, or on social media — you’re giving us permission to share and feature it in our marketing, with credit where we can. You keep ownership of what you create; you’re simply letting us use it.
Please only submit content that’s yours to share and that’s honest, kind, and lawful. We may remove anything we consider inappropriate, and we can decline to feature anything for any reason.
08 Our content & trademarks
The name The Imperfectionist®, our logo, shade names, product copy, photography, illustrations, and site design belong to us or are used with permission. Please don’t copy, reproduce, or reuse them commercially without our written consent. Enjoying them, sharing a link, or posting about a product you bought is always welcome.
09 Links to other sites
We sometimes link to organizations, resources, or other websites we think are worthwhile. We don’t control them and aren’t responsible for their content or practices. A link isn’t an endorsement of everything on the other end.
10 Privacy
How we handle your information is explained in our Privacy Policy, which forms part of these Terms. In short: we collect only what we need to run the shop and stay in touch, and we don’t sell your data.
11 Limitation of liability
We put real care into everything we make and say. Still, the site and its content are provided “as is,” without warranties beyond those the law requires and does not allow us to exclude.
To the fullest extent Massachusetts law permits, The Imperfectionist LLC isn’t liable for indirect or incidental losses arising from your use of the site or our products, and our total liability for any order is limited to the amount you paid for it. Nothing in these Terms limits any right you have under the Massachusetts Consumer Protection Act (M.G.L. c. 93A) or any other law that cannot legally be waived — including your rights when a product is defective or not as described.
12 Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts. If a disagreement comes up, we’d genuinely rather sort it out with an email first — most things resolve that way. If it can’t be resolved informally, it will be handled by the state or federal courts located in Massachusetts, and you agree to that.
13 Changes to these Terms
We may update these Terms as the business grows or the law changes. When we do, we’ll revise the “last updated” date at the top. Continuing to use the site after a change means you accept the new version, so it’s worth a glance now and then.
